Position Overview: The Assistant General Counsel is responsible for providing legal counsel and guidance to West Virginia United Health System, its hospital members, and the clinical practice plans of West Virginia University, specifically in the areas of pharmacy operations, pharmacy business operations, compliance, and state and federal pharmacy law.

MINIMUM QUALIFICATIONS:

EDUCATION, CERTIFICATION, AND/OR LICENSURE:

Juris Doctor.

West Virginia Bar membership or eligibility.

EXPERIENCE:

Three (3) years of experience in a law firm or in-house legal department in the areas of corporate, contract, health care, and regulatory law required, with a preference for experience in the following areas: (i) pharmaceutical law, (ii) fraud, waste and abuse laws, and/or (iii) 340B program.

CORE DUTIES AND RESPONSIBILITIES:

Prepares, reviews, and assists with negotiating contractual arrangements, including but not limited to contract pharmacy agreements, vendor, and other similar agreements.

Prepares, reviews, and assists with negotiating pharmacy, lab, and related agreements.

Provides regular legal guidance and advice to the Organization's management team on a wide variety of legal matters related to pharmacy operations.

Provides day-to-day advice to management and personnel regarding contracts and regulatory obligations for the pharmacy operations, including the 340B program.

Is knowledgeable of legal trends and standards which regulate health care facilities and patient care and works to ensure compliance with these standards.

Provides advice regarding compliance with Medicare and Medicaid fraud and abuse, Stark, and tax exemption.

Develops and provides education and training programs to the Organizations' pharmacy group on key legal topics.

Develops policies and procedures for the agreement submission and review process and drafts template agreements and updates for the pharmacy operations.

Responds in a timely manner to requests for advice or information.

Prepares and reviews contracts and/or agreements between the Organizations and outside agencies or organizations.

Participates in meeting the goals and objectives of the department.

Promotes and contributes positively to the teamwork of the department.

Participates in planning and implementing change and maintaining and improving productivity.

Diligently and responsibly pursues and addresses legal needs of the organizations as they arise.

WORKING ENVIRONMENT:

General office work.

Remote work will only be considered for candidates with substantial experience in pharmacy law.

SKILLS AND ABILITIES:

Excellent organizational and interpersonal skills.

Excellent verbal and written communication skills.

Ability to manage multiple tasks at one time.

Ability to work under stress and with short deadlines.

Ability to solve problems in a timely and practical fashion.

Knowledge of litigation process and procedures.

Knowledge of the general operations of corporations, limited liability companies, and joint ventures.

Knowledge of academic medical center operations preferred.

Ability to communicate and interact with administration, department heads, medical staff, and other hospital personnel.
